Newly released documents from Senator Grassley indicate Jack Smith was meeting with judges and seemingly coordinating or getting approval on strategy:

Of the meeting with Judge Howell, Smith wrote to Garland, "She liked our approach of pursuing the executive privilege litigation in an omnibus fashion." *** Howell was aware that an omnibus executive privilege motion was coming and loves the idea."

But there's this explanation:

"Attorney Bill Shipley, a longtime federal prosecutor *** noted how Howell and Boasberg were chief judges, meaning any grand jury matters were required to go through their offices."

I never practiced so I don't really know what to make of this. It seems unusual but maybe the explanation is valid. I'm curious to hear from the attorneys on this.

I will wait to opine until I see Jack Smith's response.

If Smith in fact broke the law or violated ethical rules then he should be prosecuted to the fullest extent of the law, be it civil or criminal. I wish the same fate for Trump or anyone else who violates the law.

*I will be really surprised if Smith violated the law and put it in writing. If Smith is bent, I think he would be smart about it.

Not a lawyer, but stayed at a Holiday Inn Express last night, so I'll opine:

Grassley is so old, he's likely NOT capable of doing anything other than read GOP strategic talking points and accusations, which are well founded to be the very Fake News that Trump injected into politics 10 years ago.

In other words, this is just Boston Market blah blah blah.

If you can't beat the message, shoot the messenger. Jack Smith has the goods.

I also find it inherently unbelievable that Jack Smith would appear at that House Judiciary Committee and waive his 5th Amendment privilege if this contact with the judges was unlawful and unethical.

Smith and his team obtained cell phone metadata ("toll records" showing calls, times, recipients, duration, and locations) from telecommunications companies for at least nine Republican senators or lawmakers.

Was that legal?

I know you purposefully ignore the obvious, but I'll state it for the casual passerby:

Trump consistently did and still does threaten retaliation lawsuits.

The pardons were issued only after Trump was to assume the powers as Retaliator In Chief, which is not an official title but Trump's own illegal "raison d'etre".
