"President Donald Trump is expected to drop his $10 billion lawsuit against the Internal Revenue Service in exchange for the creation of a $1.7 billion fund to compensate allies who claim they were wrongfully targeted by the Biden administration, sources familiar with the matter told ABC News.

The commission overseeing the compensation fund would have the total authority to hand out approximately $1.7 billion in taxpayer funds to settle claims brought by anyone who alleges they were harmed by the Biden administration's "weaponization" of the legal system, including the nearly 1,600 individuals charged in connection with the Jan. 6 Capitol attack as well as potentially entities associated with President Trump himself."

I think if they wanted numerical symbolism, a better figure would be $6.66. Six dollars and 66 cents, paid out in 1-6-2021 coinage, as follows:

1 (January) dime = ten cents
6 nickels = 30 cents
2 half-dollars, one for each millennium = one dollar
21 quarters = $5.25

Add it all up! Oh wait, that's only 665. We need one more penny.

"A federal judge in Miami made a striking turnabout on Friday, reopening President Trump's $10 billion case against the I.R.S. and saying that she wanted to investigate "grievous allegations" that the hasty deal to resolve it was "premised on deception."

The ruling by the judge, Kathleen M. Williams, was a significant blow both to Mr. Trump, who had voluntarily dismissed the suit last week, and to the Justice Department. After the president withdrew the suit, senior department officials released a pair of extraordinary agreements that settled the case by establishing a $1.8 billion fund to compensate people who claimed they were victims of government "weaponization" by Democrats.

The deal also conferred lucrative tax benefits on Mr. Trump, his family and his businesses.

Judge Williams's decision came in response to court papers filed on Wednesday by a bipartisan group of 35 former federal judges who urged her to bring the case back to life and dig into the details of the agreement to settle it.

Before she closed the case, Judge Williams, an Obama appointee, had questioned whether the lawsuit presented an actual conflict that she could adjudicate, given that Mr. Trump was on both sides of the suit, bringing claims against a federal agency that he controlled.When she closed it, she noted there was no "settlement of record," but shortly after, the Justice Department released its agreement foreclosing the action.

In her brief but stern order on Friday, Judge Williams said that she wanted to investigate the circumstances surrounding Mr. Trump's efforts to settle the lawsuit in a way that benefited him and his allies.

Asserting that she was "empowered to investigate serious misconduct" in a case before her, she ordered Mr. Trump's lawyers to tell her by June 12 whether the case should be formally reopened because "the court was the victim of a fraud" and whether Mr. Trump had colluded with his own government to settle the case "to avoid judicial scrutiny."

She pointed to reporting by The New York Times that described how the I.R.S. had prepared a 25-page memorandum outlining defenses against the suit that the Justice Department did not take up in court.

Lawyers for the former judges hailed Judge Williams's decision.

"The judges and their counsel greatly appreciate the seriousness with which the court is addressing these grievous allegations," said Norman Eisen, who represented the former judges. "We stand ready to work with the court as it investigates this matter."

A 100% tax looks less like a tax and more like a confiscation designed to nullify a federal program. The law could be challenged under the Constitution's Supremacy Clause, which generally prevents states from interfering with federal policies. Courts might view a tax aimed at only one politically disfavored federal benefit as discriminatory or punitive rather than a genuine revenue measure. There is legal precedent limiting states from targeting federal operations or programs in ways that frustrate congressional or executive objectives.

The state could do it, it just likely wouldn't hold up in court

I'm sure that such an excise tax on a specific group could be viewed as confiscatory or punishing a specific people without trial.

But the Constitution does grant states significant latitude to impose income taxes on residents.

CA already imposes taxes on most forms of income, including many lawsuit settlements and judgements, at rates up to 13.3% plus local add ons. A targeted high-rate of tax on a specific category of income is not unusual but not automatically barred.

I look forward to see how this plays out in the Courts.

Meanwhile, the newly introduced Wyden-Schumer legislation would impose a 100% tax on Trump insurrection slush fund payments, their press release states.

California Congressman Mike Thompson (CA-04) first introduced the bill in the House of Representatives earlier this week saying, "The SLUSH FUND Act would tax the President's unethical $1.776 billion slush fund meant to benefit January 6th rioters and other MAGA enablers at 100 percent, rightfully returning taxpayers' money back to the people of the United States."
